HC orders CBI probe into Rizwanur’s death

The Calcutta HC on Tuesday directed the CBI to investigate the mysterious death of Rizwanur Rehman and submit the report before it within two months.

Says state CID inquiry is futile as police commissioner Prasun Mukherjee believes it’s a suicide

KOLKATA: Putting the West Bengal government and Kolkata Police in a spot, the Calcutta high court ordered on Tuesday a CBI inquiry into the death of Rizwanur. The court also told the CBI to submit its report in sealed cover within two months.

Rizwanur was found dead on a railway track soon after marrying Priyanka, daughter of industrialist Ashoke Todi. His death sparked widespread protests against alleged intervention by top city cops to break up a legal marriage.

Passing the order on a petition by Rizwanur’s family seeking a CBI probe into his death, a single judge bench of justice S Pal described the ongoing state CID inquiry into the case as futile in view of the enthusiasm on the part of Kolkata Police Commissioner Prasun Mukherjee to label Rizwanur’s death as suicide even before the completion of a post-mortem.

Only a day after Rizwanur’s dead, when tension was mounting in Kolkata over allegations of involvement of senior officers of Kolkata Police in the case, Mukherjee called a press conference and described Rizwanur’s death as suicide.

He also described the Rizwanur-Priyanka marriage as a relation between two individuals coming from diametrically opposite financial backgrounds and vowed that the police will continue to interfere in such marriages.

Referring to Mukherjee’s statements in the press conference, judge Pal observed that in such a situation, a CID inquiry held no value and hence, the CBI should be entrusted with the job.

The high court also overruled the contention of advocate general Balai Roy that Rizwanur’s mother Kiswar Jahan and elder brother Rukbanur Rahman had no legal right to demand a CBI probe. Judge Pal observed that since the loss of Jahan and Rukbanur was maximum following Rizwanur’s death, they had every right to seek a CBI inquiry.

Rukbanur described the judgment as victory of the public in general. “The public, irrespective of caste, creed and religion, has stood by us in this struggle. This judgment is their victory,” he said.
