IPS can be transferred to non-cadre post

In a landmark judgment, the Central Administrative Tribunal (CAT) Mumbai bench ruled that an Indian Police Service (IPS) can be posted to a non-cadre post.

Disposing of an appeal filed by Madhav Chitale, an IPS officer posted at Nagpur as superintendent of police (Railways), the order said if a cadre post was not vacant, the officer could be posted to a non-cadre post.

Madhav Chitale approached CAT when he was posted as the Principal of Police Training School at Solapur. He brought to the notice of the Tribunal that he was aggrieved by the posting and the government should be asked to offer him a posting with the Police Commissionerate, Pune or with the Pune Rural Police.

The CAT directed the state to reconsider Chitale’s case and the government, keeping in view the officer’s imminent retirement, posted him to the Police Training School, Daund near Pune.
