Identification of nine cases during the 1992-93 riots in which Mumbai police failed to register offence; a list of 91 missing persons; names of 31 police officers against whom no action had been taken; a demand to reopen 1271 cases that were closed during the Shiv Sena-BJP government... These were the highlights of the joint affidavit filed in the apex court by Action Committee for Implementation of Srikrishna Commission Report, All-India Jamiat Ulema-i-Hind and Human Rights Union of Supreme Court Lawyers.

Supreme Court had ordered filing of the affidavit in connection with the non-implementation of Srikrishna Commission report.

Naseem Khan, secretary of the Action Committee for Implementation of Srikrishna Commission Report, told DNA that in the affidavit the committee had accused several political leaders and police officers for their active or tacit support in fomenting and fuelling riots. The nine cases identified were Hari Masjid case; Shahnawaj Wagle case; killing of a pregnant lady in Pratiksha Nagar; Hotel Lodge case; Star Metal Works case; January 1, 1993 riot case; Kandivili Pathan Chawl case; slitting of Mehrunissa Dandekar’s neck and the murder of Mohammed Adam Sayyed.

The affidavit has also provided the list of 91 missing persons and the names of 31 police officers, who had been indicted by the commission, but were yet to be punished.

The petitioners have demanded that the riot victims or their kin be given compensation on a par with the 1984 anti-Sikh riots in Delhi. The affidavit has suggested that the court should direct the Centre and all state governments to evolve means to put in place some sort of a mechanism which would ensure and enhance communal harmony in the country.

The petitioners have also alleged that the Maharashtra government had failed to implement the Sri Krishna Commission report, recommending action against top Shiv Sena leaders, including Bal Thackeray, for allegedly instigating communal violence. “No action has been taken against Thackeray, although the Commission found him responsible for abetting organised attacks on Muslims,” the affidavit stated. Only a few cases had been registered against him for his allegedly communal and inflammatory writings in the Sena
mouthpiece, it added.

The affidavit was filed in response to the apex court’s August 1 order, asking the petitioners to point out the specific instances of lapses allegedly committed by the state government; the incidents in which cases were not registered and the cases in which the accused were acquitted because of improper investigation.

Supreme Court, in the last hearing, had indicated that it would not hesitate to order re- investigation and proper prosecution of all accused on the lines of post-Godhra carnage in Gujarat. The court had clarified that it could not pass any order on the basis of findings made by the Srikrishna Commission.
