Warrant against Indian in hit-and-run case

NEW DELHI: Taking into record a letter from US Secretary of State Condoleezza Rice, a court here has issued an arrest warrant against a fugitive wanted for a two-year-old hit-and-run case in New York.

"Warrant of arrest be issued against fugitive Ganesh Upendra Shenoy for July 12," Additional Chief Metropolitan Magistrate Kamini Lau said in a recent order, acting on a communication from the external affairs ministry.

The ministry had moved the court on April 30, requesting it to initiate extradition proceedings against Mumbai-based Shenoy, who has been charged with manslaughter in the second degree according to US laws.

Shenoy allegedly fled the US two years ago after killing one Phillip Mastropolo while driving on the streets of New York on April 11, 2005.

A court there indicted him for the manslaughter charge, comparable to causing death by negligence under Indian Laws. An arrest warrant was issued in the US against Shenoy on August 10, 2005.

After Shenoy evaded the law for two years, the US government sent an extradition request to its Indian counterpart along with official documents and a certificate of authentication signed by Rice.

The communication was also supported by testimonies of an eyewitness, a medical expert and a police officer as well as certain scientific evidence.

The US government's extradition request also furnished an address for Shenoy in Mumbai as found on his passport.

The court, finding a prima facie case against Shenoy, issued an arrest warrant that is to be executed by the Station House Officer of the Parliament Street police station with the aid of Mumbai's Commissioner of Police.

Shenoy allegedly jumped a traffic signal in the early hours of April 11, 2005 while driving beyond the permitted speed limit and collided with a car being driven by the victim at an intersection.

Mastropolo died on the spot, following which a criminal indictment report was filed against Shenoy in the Supreme Court of the county of Nassau in New York in August 2005.
