MUMBAI: Gangster-turned-politician Arun Gawli was finally discharged from a 16-year-old extortion case by the Bombay High Court on Wednesday.
 
Overturning a judgment handed out by the Sessions Court, Justice SC Dharmadhikari held that there was no evidence showing Gawli’s involvement in the crime, and discharged him.
 
The case dates back to 1990, when Ahmed Sheikh, a Byculla resident filed a police stating that three unidentified people threatened to kill him if he didn’t ask his employer, Ratilal Shah, to pay them Rs4 lakh.  Gawli’s name was also used by them.
 
The Sessions Court had in August 2005 ruled that although Gawli wasn’t named in the FIR, the co-accused clearly mentioned his name during interrogation and there was grave suspicion that he may be involved in the case.
 
Gawli approached the HC, challenging the Sessions Court order in 2005.
 
Justice Dharmadhikari ruled, “Suspicion, however strong, cannot take the place of evidence and a charge cannot be framed on the statements of co-accused.”
 
Hence, Gawli’s involvement in the crime was not proved and he was discharged.
