Centre says it will amend Delhi masterplan

NEW DELHI: The Centre said on Thursday that it will amend Delhi's masterplan before the restart of sealing next month on the Supreme Court's orders.

Earlier, the Supreme Court stayed the May 20 notification of the government allowing desealing of the commercial establishments illegally operating in the residential areas of the national capital.

A bench headed by Chief Justice Y K Sabharwal said the properties, which were sealed under the direction of the court, will have to be sealed again. There were 5006 properties, which were sealed on the direction of the court.

The court said the premises, which were de-sealed persuant to the notice of May 20, will have to be resealed with effect from September 16.

About those, who had given affidavit with an undertaking to cease the misuse by June 30, the court extended the time to comply with the undertaking given by 40,814 commercial establishemnts upto September 15.

The court said that the monitoring committee appointed by it will examine these cases and ensure compliance of undertakings and directions and file a report in terms of the court's orders.

The court directed the monitoring committee to examine broadly the roads and activities in respect of the undertakings given as also in connection with 5006 premises sealed so that it may consider issuing directions for stopping of misusers or others similarly placed but have not given undertakings.

The court said that at this stage it was not inclined to grant complete stay of the legislation -- Delhi Laws (Special Provisions) Act 2006 -- though prima facie it agreed with the petitioners that it was an invalid statute.

The court said it was examining the constitutional validity of the Act in the wake of  public interest litigations alleging that it was illegal and arbitrary.
