Illegal structures: owners to pay hefty fines to PCMC

Civic body will net Rs42 crore; order applies to properties that came up in 2008

The illegal constructions in Pimpri-Chinchwad that came up after January 4, 2008 will have to pay a fine double the amount of property tax along with the property tax amount to Pimpri Chinchwad Municipal Corporation (PCMC).

The state government has issued orders to PCMC to collect the fine from financial year 2012-13. With this order 43,392 illegal construction in the twin town are going to be affected.

PCMC will get additional revenue of Rs42 crore annually with collection of fine amount. After this order, owners of illegal constructions will have to pay three times the property tax of their property every year as long as the construction remains illegal.

Property tax department chief and assistant commissioner Bhanudas Gaikwad informed reporters about the order scrapping PCMC general body’s resolution on the issue. PCMC received the order on November 22.

Gaikwad said, “There is provision of imposing double penalty along with property tax to the illegal structures in Section 267 (A) of the Maharashtra Municipal Corporations Act. However, the PCMC standing committee and general body has passed a resolution stating that the fine should be equal to the property tax. The same was submitted to the state government for final approval. The PCMC has issued notices to these constructions as per the resolution.”

The state government scrapped PCMC’s resolution in accordance with Section 451
(3) of the Bombay Municipal Corporations Act. The PCMC received a written order from the secretory of urban development department on November 22.

Last year, PCMC issued bills to these constructions which included fine of equal amount as property tax. But this year PCMC is going to recover amount with the difference of last year’s lower penalty. It simply means owners of these constructions will have to pay four times the property tax this year.

When asked about the issue, PCMC commissioner Shrikar Pardeshi said, “The double penalties will be recovered as per the rules of the state government. The implementation of the rule is from 2012-13. The recovery can’t be made retrospectively beyond this year. The penalties will be imposed on illegal structures that is came up after 2008.”

Sena opposes move
Shiv Sena group leader in PCMC, Shrirang Barne, who is opposing the state government decision and demanding regularisation of all these structures said, “It is unfair to collect double penalties from illegal structures. We are going to take out a protest march during the winter session of the state legislature in Nagpur on this issue.”
