Housing society in Viman Nagar sue the builder for no water supply and fault STP

Irked over the insufficient water supply leading to mounting water bills and faulty design of sewage treatment plan, 221 residents of a housing society in Viman Nagar have moved the court against Naiknavare Developers and its partners.
What's interesting is that the housing society members have made the Pune Municipal Corporation (PMC) also a party to the case, claiming the civic body granted an occupancy certificate (OC) without checking proper infrastructure. Civil judge (senior division) RR Rathi has issue notices to the builder, its partners and PMC in this case.
The residents of Mystique Moods Co-operative Housing Society Limited based in Viman Nagar represented by Kailash Kothawale had filed the plaint before the civil court by their lawyers Devanand Dhokane and Lalit Jhunjhunwala against Naiknavare Developers Private Limited, its partners and PMC commissioner. The residents have prayed that the opponents must repay Rs 25 lakh, which they spent on water tankers, additional Rs 50 lakh as damages to make them living under inhuman condition.
Speaking to dna, a software techie Shyam Rewaskar treasurer of the society said, "We had got the flat possession in 2009 and there are seven buildings in our entire housing society. PMC did not check if there is adequate infrastructure in place to fulfill the water requirement of the citizens. It granted Occupation Certificate for the development in favour of the builder and its partners. As per the norms, it's the builder's responsibility to arrange for water by sending water tankers till PMC is not able to supply adequate water. The builder and its partners turned a blind eye. There are more than 1000 citizens living in the entire society, mostly children and elderly people. We have scarcity of water, no water for drinking and washing purpose. As society members, we have no other option, but to purchase water from the water tankers and have spent Rs 25 lakh from 2010 to date over it."
Due to scarcity of water for the sole reason, we are forced to use water being generated out of the Sewage Treatment Plant (STP) in society.
He added, "In addition to it we have also spent Rs 3.92 lakh towards the repair and maintenance of the STP as its design is faulty is producing water unfit for human consumption and resident are forces to utilise the same."
Hemant Naiknavare, who is director of Naiknavare Developers said, "The matter is sub-judiced, court will take decision on it, would not like to comment on it." He added, "All I can say is that, We are been falsely implicated."
