Convicts of the Godhra train carnage case on Monday filed a petition in the Gujarat high court for revoking of Section 268 of the CrPC from their case. Section 268 was imposed on the accused when they were lodged in Sabarmati jail and because of this section, they cannot be brought out of jail due to security reasons.
Earlier, special judge PR Patel had sentenced 11 accused to death and given life imprisonment to 20 others in the case in which 59 kar sevaks were killed in the train fire at Godhra railway station on February 27, 2002.
“The HC has admitted the matter and fixed May 10 for further hearing of the petition,” said JM Panchal, counsel for the SIT. The convicts have stated in their petition that trial in the case had been concluded and now there is no security threat.
