Bombay high court, on Thursday, handed over investigation of RTI activist Satish Shetty’s murder to the Central Bureau of Investigation (CBI). A division bench of Justice F I Rebello and Justice Amjad Sayed has now directed the CBI to file its affidavit on April 21.

The court directives came following a statement made by additional government pleader (AGP) Nitin Deshpande. Deshpande informed the court that the state had issued a government resolution (GR) on April 6 and decided to hand over the case to the CBI.

Also, last week home minister RR Patil had said the
government was considering handing over the case to
the CBI.

Taking note of the statement made by Deshpande, the court transferred the case to CBI. “Considering the circumstances which led to the death of Satish Shetty, it is necessary for the CBI to investigate the case,” the judges observed.

The CBI will now have to state the steps they propose to take during investigation.

A division bench presided over by Justice Rebello had, in January this year, taken suo-motu cognisance of the Shetty murder case. The court had then called for an investigation report and also appointed senior counsel Dinyar Madon as amicus curie.

Satish’s younger brother, Sandeep had, in February, filed an intervention application. Sandeep expressed dissatisfaction over the CBI probe. He also named a prominent businessman behind his brother’s death.

Satish Shetty, 39, was murdered by unknown assailants on January 13 at Talegaon, in Pune, while on a morning walk.
On January, 8, unknown persons shot at the home of Nayana Kathpalia, co-convenor of NGO-CitiSpce. The state government filed an affidavit in January saying all state police stations had been directed to follow a procedure for protecting activists.
