New law to fast-track redevelopment soon

As per the rulebook, a person looking to redevelop a piece of property has to take consent from 70% of the tenants on it. In some cases, however, evicting the remaining 30%of the tenants becomes difficult, and the project is stalled.

The tenants often ask for more money and harass the developer as well as the government. To ensure these redevelopment projects stay fast tracked, the government is planning to make changes in the law.

Mhada vice president Satish Gavai sent a proposal to the government regarding the same, and the latter has decided to give the proposal a green signal. A government resolution (GR) will be issued in the next one month.

As per the authority’s new recommendations, if a developer has consent from 70% of the tenants for redevelopment, and the rest are not ready to give up acquisition, he has to give the latter a time limit of 6 months or one year. After this time expires, the government will acquire the land by applying a 41/1 notification, and the tenant will only be given the ready reckoner rate, to his loss.

Gavai said, “Many important projects are stalled because of these people, and the other 70% face problems because of them. That’s why we have decided to make some changes in the procedure, so that these projects will not be affected. It is to the benefit of the tenant as well as the government.”

The prices of land as well as flats are extremely high in Mumbai. This is why, in the past decade the government and developers have been concentrating on redevelopment projects.

For old buildings, the government is offering 2.5 floor space index (FSI), which is why it is convenient for both parties to redevelop. But many of these projects are stonewalled by people who oppose them for some reason or the other.
