If you are thinking of buying land at Sahar village, double-check the documents as chances are that you might end up with a piece of land that is under litigation. The land in question is a 3-acre plot behind the Air Traffic Control (ATC) tower near Sahar village.

“We have found out that two individuals, Roy Ambrose Creado and Lakhabhai Chauhan, are falsely claiming to be entitled to the said land. However, the said land is under litigation since the 1990s,” said an official from Mumbai International Airport (MIAL).

To warn the public of these unscrupulous elements that might attempt to sell the land under litigation, MIAL published an advertisement in the newspapers, stating that the “land situated at Sahar Village…(are) duly acquired and are vested with the Airports Authority of India (AAI) and have been leased to MIAL vide a duly registered lease deed dated 26th April 2006.”

It also warns people that MIAL or AAI will not be liable if people go ahead and buy land with the above mentioned parties, continuing that “any type of agreement of sale in respect of the sad land will neither be binding on AAI or MIAL in any manner...any such transaction shall be considered as illegal and void.”

When contacted, Lakhabhai Chauhan said that the matter is in city civil court, Dindoshi, Goregaon; and the MIAL has no right to advertise in the papers.  “We have filed a suit in the court  when they came to vacate us forcibly from the land where we have been staying and farming for the last 60 years.  We have not created any third party right that they should advertise the matter in the paper,” said Chauhan.
