Mediation opens criminal’s humane side

History-sheeter agrees to stop harassing wife and take care of his children.

Successful mediation by the Pune District Legal Services Authority (PDLSA) between a victimised wife and her husband resulted in an amicable settlement between them in the interest of their school-going children recently.

Minakshi Patil (25) of Pashan filed a complaint against her husband Nikhil under the Protection of Women from Domestic Violence Act, 2005, before a magistrate’s court, seeking maintenance for herself and her two children.

Minakshi and Nikhil got married on November 29, 2003, at Alandi Devachi, but soon after her dream of leading a happy married life was broken as she came to know that Nikhil was a history-sheeter and had been served an externment order by the city police.

In the hope that Nikhil would improve his behaviour, she continued the marriage and meantime gave birth to two children. However, Nikhil paid no heed to her and their children.

He repeatedly assaulted Minakshi after getting drunk and mentally harassed her whenever she objected to his behaviour. He even threatened his family members when they tried to mediate between  them.

Two years ago, Nikhil attacked Minakshi under the influence of alcohol, so she went to her maternal home with two children, who were attending nursery school. After going through mental and physical harassment by her husband, she filed the complaint through advocate Lalit Bhandari.

Bhandari said when the court transferred the case to the PDLSA for settlement. Considering the future of
the children, she wanted to live with her husband only on the condition that he should look after them
well.

Member secretary of the PDLSA, RK Malabade, brought both the husband and wife face-to-face and mediated successfully and the two decided to live together. Even Nikhil vouched before Malabade that he would not harass Minakshi and would look after the children.
