Maharashtra govt plays down J Dey murder

The government on Tuesday opposed the petitions filed by a bunch of press organisations and individuals seeking the transfer of investigations in the J Dey murder case from the Mumbai Police crime branch to the Central Bureau of Investigations (CBI).

The state government on Tuesday strongly opposed the petitions filed by a bunch of press organisations and individuals seeking the transfer of investigations in the J Dey murder case from the Mumbai Police crime branch to the Central Bureau of Investigations (CBI).

Advocate general Ravi Kadam, representing the state, said: “It is not an exceptional case that investigations should be transferred to the CBI. There are other cases that have major ramifications — like the Satyam fraud — and so the investigations in such cases are transferred to the apex agency.”

He added: “In this case, the crime branch has arrested eight accused and invoked the MCOCA. All executors of the crime have been arrested and further investigations are still on.” The state was responding to petitions filed by the Mumbai Press Club, advocate VP Patil and others.

Replying to allegations that the police are leaking information to the media, tarnishing Dey’s image and causing pain to his family, Kadam said: “It is the responsibility of the police to give out information to the public. This is a case that is being keenly followed by the public right from the day of the incident.

High-ranking officers provide details through press conferences, while ensuring that the revelations do not hamper the case.”

The division bench of Justice Ranjana Desai and Justice RV More hearing the case observed: “We see prosecutors appearing on camera and giving information. This is not proper at a time when the trial is going on. There has to be a balance.” In response, Kadam said that the officers only give a gist of what the witnesses have told them.
