Laptop dealer told to pay Rs10,000 for mental agony

Seven years after Raji Nathwani, a Chira Bazaar resident, landed with a laptop purchase gone bad, the district consumer forum has ordered a computer dealer to pay Rs1,00,271 along with a 9% interest from 2005 for denying the former a Sony Vaio laptop, for which all due payments had been made.

Braintone Infosys and its office-bearers were also ordered to pay Nathwani Rs10,000 towards the mental agony, apart from Rs4,000 towards the litigation cost incurred.

Nathwani, who had approached the dealer to buy a Sony Vaio laptop, was told it would cost him Rs1,49,860. He was offered a pay-back scheme from a finance company for paying the instalments. As Nathwani needed the laptop urgently, he made an advance payment of Rs37,465 while placing the order. When Nathwani’s mother gave the dealer three cheques, each valued at Rs15,500, he demanded Rs62,806 cash instead of cheques for the sake of “quicker delivery”.

Nathwani also entered into a hire-purchase scheme with the finance company which the dealer had a tie-up with, and submitted 14 pre-paid cheques while his mother stood guarantor for the said loan. However, the dealer failed to deliver the promised Sony Vaio laptop, claiming that it out of stock. Instead, he gave Nathwani a Compaq laptop, which after some time, malfunctioned and the consumer was back to Braintone with his original demand of a Sony Vaio laptop. When the dealer tried to push a Toshibha laptop as a replacement, Nathwani demanded his money back, along with the pre-paid cheques given to both the dealer and the finance firm.

Instead, he was prosecuted by the dealer under the Negotiable Instruments Act for dishonouring the cheques. The finance firm’s officials even forced out two demand drafts by summoning him to the LT Marg police station. Feeling cheated, Nathwani moved the consumer court.
