High court stays proceedings to extern Dadar resident

The Bombay high court has stayed chapter proceedings (chapter proceedings are proceedings initiated for externment of a habitual offender) initiated against Shubhangi Thakur who is fighting a Shivaji Park property dispute with relatives.

Shubhangi alleged that Vijay Kamble— the additional director general, anti-corruption bureau— has been meddling in the property dispute.  She adds that Kamble’s interference has resulted in the police filing false cases against her and trying to extern her from the city.

Shubhangi and her relative Neela Thakur are fighting over a one-storey building in Dadar. Kamble is related to Neela, argued Rajiv Patil, Shubhangi’s advocate.

Patil argued that Kamble has been protecting Neela. Kamble even visited their house and threatened Shubhangi and asked her to vacate the place, alleged Patil.

On one occasion Neela and some other family members assaulted Shubhangi in Kamble’s presence. Instead of restraining them, Kamble encouraged them, alleges the petition.
Shubhangi was hospitalised following the attack and was undergoing treatment for three days at King Edward Memorial (KEM) Hospital.

When Shubhangi went to the police station to lodge an offence against Neela and the others involved. But the Shivaji Park police refused to register her compliant after learning of Kamble’s relation to the matter, alleges her petition.

Refuting the allegation, advocate general Ravi Kadam informed the court that an NC (Non Cognisable offence) had been lodged of Shubhangi’s compliant.

Kadam even showed the cross complaints lodged by both Shubhangi and Neela against each other. Kadam even submitted the medical papers of Shubhangi’s treatment at KEM Hospital.

Patil had informed that Shubhangi had taken a video of Kamble leaving the premises after she was assaulted.

A division bench of justice BH Marlapalle and justice UD Salvi have asked the police to produce the recorded clip.
The petition prays for an investigation by an independent agency like the Central Bureau of Investigation or the Crime Investigation Department.

Shubhangi’s petition will come up for hearing in a  week’s time.
