Decks cleared for Daya Nayak’s return

After more than five years after his arrest and eventual suspension from the police force, all roads now seem to be clear for former encounter specialist Daya Nayak to return to the force. The Anti-Corruption Bureau (ACB), which is investigating the alleged charges of corruption against Nayak, has informed the court that there are no grounds or evidence on the basis of which Nayak can be prosecuted.

The ACB had arrested Nayak in February 2006 on alleged charges of corruption. However, the agency failed to get the requisite sanction from the then DGP to prosecute him and file a chargesheet against him in 2009. Following this, the court had once again asked the sanction authority (DGP) to reconsider the matter and independently apply its mind and pass an order whether sanction could be granted to the ACB to prosecute Nayak.

Based on the orders passed by the court, DGP Ajit Parasnis has given a report to the ACB in which he has said that there is no sufficient evidence to grant sanction. “In the light of the settled position of law and the fact that no new material has been brought on record by the ACB, for reviewing the earlier decision taken by the then DGP, declining the sanction, it will be beyond the four corners of law to reconsider the said decision,” the DGP has said in his report.

Following this report from the DGP, the ACB has submitted a report in the Sessions court informing the court about the development. According to sources, after this report, there is no case made out against Nayak and the ACB cannot chargesheet or prosecute him.
