The Bombay high court on Wednesday set aside the election of Shiv Sena MLA from Malegaon, Dadaji Dagdu Bhuse, to the 2009 state legislative assembly, for not taking an oath and not declaring details about the 21 cases registered against him.

The Bombay high court on Wednesday set aside the election of Shiv Sena MLA from Malegaon, Dadaji Dagdu Bhuse, to the 2009 state legislative assembly, for not taking an oath and not declaring details about the 21 cases registered against him.
Judge Roshan Dalvi, passed the order on the petition filed by opposition candidate Arjun Bhuse, challenging the election stating that under section 173 (A) of the Indian Constitution, he had not taken the oath and also not given the description of the offences registered against him.
It was brought before the court that information about the 21 cases given by Dadaji, mentions only the charges of the cases registered. Further, it is also not mentioned if the offence is punishable for more than two years or if the court has taken cognisance of the case or whether the charge has been proven.
