The Bombay high court has refused to vacate the stay granted by it earlier on the concretisation of the central course of Devnadi.
The high court gave its decision while hearing a special review petition for the public interest litigation (PIL) filed by the Baner Area Sabha (BAS) and Jal Biradari.
The two-judge bench of Chief Justice Mohit Shah and justice Girish Godbole stayed the work of concretisation of the central channel of the Devnadi, undertaken by the Pune Municipal Corporation (PMC) on May 7.
The work was part of the Rs400-crore nala improvement project.
On Tuesday, the director of town planning department was directed by the high court to file an affidavit on whether the detailed project report (DPR) of the nala improvement work was in accordance with the development plan (DP) of the city.
The case will come up for hearing on June 20. In another development, the ministry of environment and forests (MoEF) has filed an affidavit before the court, stating that the nala improvement work does not require an environmental impact analysis (EIA) from the ministry.
The ministry took the step after the Bombay high court had directed it to file its say.
