A division bench of Justice BH Marlapalle and Justice Nishita Mhatre has asked the government and senior police officer Harish Baijal to discuss and find an amicable solution to the controversy.
The court was hearing an appeal filed by Baijal challenging the order of the Maharashtra Administrative Tribunal (MAT) confirming his transfer from Nashik to Thane on June 24.
Baijal and director general of police K Subramaniam have made counter allegations against each other.
During the hearing on Friday, justice Marlapalle observed that Baijal’s transfer from being an SP, ACB, Nashik to DCP, Thane, seemed like a punishment posting due to friction between the two officers. Both officers have written to the home department.
“The government should use its mechanism and find the solution rather than castigating one officer.”
“We are not saying that he (Baijal) must stay there (Nashik) as a matter of his right. But it’s a matter of his career. We don’t expect anyone to withdraw anything, but find a solution without causing damage to anyone,” said Marlapalle.
Special counsel Venkatesh Dhond, while arguing for the government, said that they were considering initiating an inquiry into the complaints sent by both officers.
“However, as a precaution, we transferred Baijal to Thane. It was only to ensure an impartial inquiry,” said Vagyani.
