Even as the focus is on Beed regarding the sex determination test, no action has been taken against a city doctor caught for the same crime last year.

The Maharashtra Medical Council (MMC) is yet to get the legal papers from the Brihanmumbai Municipal Corporation (BMC) on the errant doctor. Only after getting the documents can it take action against the doctor.

In July last year, an NGO along with BMC officials caught Dr Ivan Rocha, the consulting gynaecologist at JP Hospital, Saki Naka, in a sting operation while he was carrying out sex determination tests. The officials seized three sonography machines.

Dr Rocha was also working as an assistant honorary professor at the Kurla Bhabha Hospital. After the incident, he was removed from the post but he continues working at JP Hospital.

In a meeting with the chief secretary office in Mantralaya on Tuesday, the MMC members pointed out loopholes in the system that is shielding many errant doctors like Dr Rocha.

"We apprised the chief secretary's office about the Pre-Conception and Pre-Natal Diagnostic Techniques (PCPNDT) law and the problems we faced. There will be another meeting on Friday and we are hoping to discuss issues of female foeticide and sex determination tests," said Dr Shiv Kumar Utture, an executive member of MMC.

One of the concerns raised by the MMC is the delay from the local officials in sending the legal papers of the convicted doctors to the council. According to the council members, this is leads to delay on their part in suspending the registrations of these errant doctors.

"Before we cancel the registration of the doctor, we need the local government authority to submit us all the legal papers related to the case. Only then we can send a show-cause notice to the doctor and take action," said Dr Kishore Taori, president of MMC.
So far the MMC has sent show-cause notice to 31 doctors in the state and suspended registrations of five doctors.
