5% mark cut: Bombay high court refuses to halt GLC admission

The students of the Government Law College (GLC) can breathe easy with the Bombay high court dismissing the petition filed by a student challenging the admission process as 5% marks were deducted from her total percentage for not being from the state.

While dismissing the petition, a division bench of justices AM Khanwilkar and RY Ganoo observed that it would be improper to upset the admission process at this stage when the first semester has already begun.

The court further observed that even the reworked admission list of students indicates “palpable disparity” and students from Maharashtra were at disadvantage.

The court has observed that the reworked merit list prepared by the college without deducting 5% marks of students from outside Maharashtra “only reinforces apprehension” expressed by the Advisory Committee that Maharashtra students will be at a disadvantage.

As per the reworked merit list of open category, the first and only candidate to secure admission from Maharashtra board was at serial number 35. “The said student (at serial number 35) scored 90% marks in Marathi and stood first in Mumbai division,” observed the court. Similarly in the reworked list of commerce stream, first candidate from Maharashtra is at serial 8 and from the science stream is at serial 12.

The judges observed: “This disparity is worse considering the fact that the number of students appearing through Maharashtra board are substantially higher as compared to the negligible number of candidates residing in Mumbai/Maharashtra appearing through boards other than Maharashtra board.”
