Why after two years: Mumbai sessions court on woman's complaint of rape

The court says that the man cannot be held behind bars on the grounds that he would harm the complaint, particularly when the woman hasn't explained why she approached the police so late

A Sessions court has granted bail to a 24-year-old man accused of raping his senior female colleague since 2016, observing that there was no reason for the educated woman to wait for two years to level the charges.

The court said that the man cannot be held behind bars on the grounds that he would harm the complaint, particularly when the woman hasn't explained why she approached the police so late. While the woman is married, the man is younger to her by four years.

According to court papers, the complainant, a mechanical engineer, and the man were colleagues in a Bhandup-based consultancy firm. "From the contents of the first information report [FIR], it is revealed that it was a case of love affair," observed the court as it granted the bail.

Citing the documents before it, the court took note of the fact that the man had forced the woman to abort pregnancy in February this year. "But even then, she kept mum and did not report the incident which clearly shows that it was a mutual relationship and thus he cannot be kept in jail," held the court.

In her complaint to the Bhandup police, the woman said the accused had promised to marry her and had asked her get divorce from her husband. She said they had sex on seven to eight occasions last year. After she underwent an abortion, she alleged, the man refused to marry her. Finally, she lodged a complaint against in this month.

In his defence, the man said their physical relationship was purely consensual. He said the woman implicated him in a false case so late only to "save her skin from her in-laws".
