Separate state for Vidharbha has no legal hiccup: Experts

According to some constitutional experts, if the BJP is determined, then they can pass the separate Vidharbha bill on the lines of Andhra Pradesh Reorganisation Act 2014.

Even when the Maharashtra state assembly rejects carving separate Vidarbha statehood proposal in its house, the Parliament has full legal rights to table and approve the reorganisation of the state bill.

According to some constitutional experts, if the BJP is determined, then they can pass the separate Vidharbha bill on the lines of Andhra Pradesh Reorganisation Act 2014.

"Having absolute majority in the Lok Sabha, it will be very easy for BJP to get the bill passed there. Besides, in Rajya Sabha as well, most of the small parties are in favour of the separate statehood. So, it will be a cakewalk for them to get the bill approved in both the houses of the parliament," said an expert.

He said that the BJP is on the right track by tabling the non-administrative bill by its Vidharbha Member of Parliament Nana Patole. "Shiv Sena, Congress and NCP may unitedly oppose the separate Vidharbha statehood.

However, technically, they do not have the power to stop or derail the bill. Creating ruckus in either of the houses will not affect the process of the parliament," said constitutional experts.

Another expert added that during Telangana separation, the Telangana Bill was rejected by the Andhra Pradesh assembly unanimously but was still passed by the central government. "The central government went ahead and approved the separate Telangana Bill. The same thing can happen in Maharashtra as well," he added.

A BJP MP from Marathwada on the condition of anonymity told dna that BJP leaders, including chief minister Devendra Fadnavis and union minister Nitin Gadkari, are very much clear about separating Vidharbha. "RSS-BJP is always in favour of creating smaller states as they are very easy for them to implement their agenda. Besides, in most of the newly created smaller states, BJP has easily got the mandate. BJP is aware that by making a separate Vidharbha, we may lose the power in rest of the Maharashtra. But, we are confident to revive the network once the anti-incumbency build ups," said the BJP MP.

A senior government official also admitted that chief minister Devendra Fadnavis was giving more focus to Vidharbha region while allocating funds. "It shows that BJP wants to use all Maharashtra state budgetary funds for infrastructure development in Vidarbha before it is separated. The separate Vidharbha statehood will happen before 2019. For instance, if you glance at the GR of the irrigation department, 90% project approvals and fund allocations have happened in Vidharbha region only," said another BJP minister requesting anonymity.
