Take action against vehicles carrying livestock sans licence: Bombay High Court to Maharashtra government

The trust in its petition said that as per an amendment in the Motor Vehicles Act, Section 125(E), transportation has to be done only in those vehicles which have special licences.

The Bombay High Court has orally directed the state government to take action against those commercial vehicles carrying live stocks —goats, chicken etc. without having special permits/licences issued by the RTO for ferrying the same.

A division bench of Justice Ranjit More and Justice Anuja Prabhudessai, while hearing a petition filed by NGO Viniyog Trust, said, “See to it that you do not allow vehicles to carry live stocks without having the permits, or else we will direct you.”

The trust in its petition said that as per an amendment in the Motor Vehicles Act, Section 125(E), transportation has to be done only in those vehicles which have special licences. As per information gathered under the Right to Information Act, it is found that no vehicle in the country has the special permits. Thus, it is a gross violation of the provisions.

Advocate Raju Gupta, who has filed the petition for the trust, seeks directions to the authorities to take action against the vehicles plying on the roads carrying live stocks.

Public prosecutor Prajakta Shinde, appearing for the state, informed that authorities are taking regular action against the offenders and regular monitoring of movement of live stocks is being done. To this the bench asked her to file an affidavit giving details of the steps taken to ensure proper compliance of the law.
