Succession battle divides Bohri community

Considered to be the largest redevelopment project in the nation, carried out at Bhendi Bazaar by the Saifee Burhani Upliftment Trust, it was envisioned by the 52nd Dai of the Dawoodi Bohra community, late Syedna Mohammed Burhanuddin,. The plan is now being taken forward by his successor the 53rd Dai, Mufaddal Saifuddin. However, the post of the 53rd Syedna is under challenge at the Bombay High Court, which has divided the community.

The name Saifee Burhani Upliftment Trust, combines the Late Dr Syedna's name with his father, Dr Syedna Taher Saifuddin. The project is inspired by the commitment and affection of both the Dai's to the community, which they jointly led through the sweep of the 20th century.

The succession battle was initiated soon after the demise of Burhanuddin, in January 2014, by the incumbent 53rd Syedna's uncle, Khuzaima Qutbuddin. In his declaratory suit, Qutbuddin had sought to be declared as the 53rd Dai and that the opponent be restricted from having any authority over the properties.

Pending the hearing of the suit, Qutbuddin passed away in April last year in the USA. His son, Taher Fakhruddin Saheb, sought to amend the original suit and add him as the plaintiff to prove the claim of his father and also lead evidence with a prayer that since before his demise he was anointed as the successor to his post (54th Syedna), the court should declare the same.

Saifuddin, through his elder brother Dr Qaidjoher Ezzuddin, who is appointed as the Constituted Attorney, has opposed reliefs sought in the declaratory suit filed by Qutbuddin, stepbrother of the late 52nd Dai, Mohammed Burhanuddin.

Qaidjoher has contented, "The suit is based on false and untenable cases. Bohras across the world have given misaq (oath of allegiance) to Mufaddal...only a handful from the community has not accepted him."
