Sessions Court: Man claims estranged wife forced 2.5-year-old son smoke hookah

Divorce proceedings between a husband and wife took an ugly turn in the Sessions Court this week, after the husband accused the wife of making their two-and-a-half son smoke a hookah. He has also filed a case against his estranged wife under the Cigarettes and other Tobacco Products Act (COTPA).

Divorce proceedings between a husband and wife took an ugly turn in the Sessions Court this week, after the husband accused the wife of making their two-and-a-half son smoke a hookah. He has also filed a case against his estranged wife under the Cigarettes and other Tobacco Products Act (COTPA).

The Sessions Court, while granting her anticipatory bail, held that divorce proceedings are filed before a family court.

The court's orders further read, "Allegation against the woman is that she had sent a video clip to her husband, that showed hukkah being offered to her son by her brother. The main accused in this case is the brother who is offering hukkah to the child. The Magistrate Court has already granted bail to her brother."

The couple was married in 2014, and the wife has possession of their son. After the woman's brother filmed a video of the son smoking a hukkah, this was forwarded to her estranged husband, who then used it in his case. A case under the Juvenile Justice Act as well as COTPA was filed against the wife's brother, who was arrested and later released on bail.
