POCSO court sentences youth to 10 years in jail for rape of cousin

The special Prevention of Children against Sexual Offence act (POCSO) court on Wednesday held a youth guilty of raping his 12-year-old cousin sister, thus sentencing him to ten years of rigorous imprisonment along with a fine of Rs 2 lakh. The court in its orders maintained that the fine amount would be given to the victim as a compensation.

The special Prevention of Children against Sexual Offence act (POCSO) court on Wednesday held a youth guilty of raping his 12-year-old cousin sister, thus sentencing him to ten years of rigorous imprisonment along with a fine of Rs 2 lakh. The court in its orders maintained that the fine amount would be given to the victim as a compensation.

According to the prosecution's case, the victim was staying with her grandparents in Mumbai, while her parents along with her other siblings were residing in Uttar Pradesh. It was then, in February 2012, when the accused who was 'hhaiyya' of the victim, had visited the victim's grandfather's house.The grandparents had been to the hospital to seek treatment to the victim's grandfather, who was suffering with cancer.

On the fateful day, the victim, around 2 pm, came home from her school and asked for her house keys from the neighbour. The neighbour informed her that her ‘bhaiyya’ had come and taken the keys to open the house. The victim, went inside the house and saw the accused sitting in the mezzanine floor and so again came and sat at the neighbor’s place.

“The accused, after some time called the victim, to help him find some food, claiming that he was hungry. When the victim approached him with a packet of biscuit, the accused grabbed her, tied her hands, and forced himself on her. Post the completion of the dastardly act, the accused told the victim that he had recorded the act and that if she informs anyone, he would post the video on the internet and make it viral,” the prosecution’s case reads.

The accused continued with the offence for almost six months and used to visit the victim, whenever she was left alone at home. Meanwhile in the year 2013, her parents shifted to Mumbai along with her siblings, so the victim went to see them. Her father realised some change in her and so he asked her if she was alright. However, afraid of her father, she refused to say anything. However a few days later, she gathered courage to inform her father, when the father, who was in an inebriated state, started touching her inappropriately. “A separate case of POCSO has registered against the father in other police station,” the case speaks.

After the matter was known in the family, the victim’s grandfather took the child to the police station and registered a case against the accused.

The prosecution apart from the medical evidence, relied on the statements of eight witnesses and all supported the prosecution.
