Industrialist Nusli Wadia can depose as a witness in the trial against Kirti Ambani, a senior executive at Reliance Industries Ltd (RIL), who is accused of allegedly conspiring to murder the industrialist in 1989-90.

The Bombay high court on Thursday dismissed a petition filed by Ambani challenging lower court's order allowing Wadia to depose. Justice Revati Dere dismissed Ambani's petition observing that there was no need to interfere with the lower court's order.

The HC also rapped the CBI for failing to take necessary steps for summoning Wadia as a witness even though had willing to come forward.

Ambani had filed a petition seeking quashing of the order of special CBI judge allowing Wadia's application to depose saying it practically amounted to retrial.

Wadia had made an application in February, through his counsel Mahesh Jethmalani, before the special court praying that he be examined as a witness for the motive and "wider conspiracy" behind the alleged murder attempt on him in 1988-89. The special CBI court allowed the application on April 30. Ambani challenged it through advocate Prakash Naik.

Background
The police had lodged an FIR on July 31, 1989, against Ambani. The case was transferred by the state government to the CBI on August 2, 1989. In 2003, the special judge framed charges against Kirti Ambani and others — Arjun Babaria, Ivan Sequeira and Ramesh Jagothia — for "criminally conspiring in 1988-89 to murder Nusli Wadia, then the chairman of Bombay Dyeing". The court specifically charged Kirti Ambani with "instigating and abetting the commission of offence, which is punishable with death sentence". Jagothia was additionally charged under the Arms Act for the possession of a country-made revolver in July 1989.
