The Bombay High Court has restrained the Mumbai Metro Rail Corporation Limited (MMRCL), constructing the Metro 3, from carrying out any tunnelling work under the two Parsi agairy temples in Kalbadevi, till September 18.

A division bench of Acting Chief Justice Naresh Patil and Justice GS Kulkarni, which started hearing afresh the petition filed by members of the Parsi Community, challenging the metro work, and seeking a realignment of the line. The petitioners opened their arguments and sort five hours to complete. Following which, the court, at the end of the working hours, adjourned the hearing to September 18, due to paucity of time.

Recently, a Veermata Jijabai Technological Institute (VJTI) report had said that tunneling work and operation of Metro 3, under the two Parsi fire temple, at Kalbadevi, will not be have any adverse impact on the temples/wells.

The report recommended that excavation work for Kalbadevi station near the corner of Wadiaji Atash Behram shall be carried out by drilling line holes up to the bottom for the plan area 3x3 meters. Further excavation in the remaining area shall be carried out by mechanical means or controlled blasting. The perforation by line drilling will further reduce vibrations on Atash Behram Buildings.

It is also recommended that both Atash Behram structures should be closely monitored for settlement, vibrations, tilt and change in crack width before, during and after tunnelling and construction of proposed Kalbadevi station. Vibration monitoring shall be done on a 24/7 basis, during construction work. The Well also should be closely monitored for water level and water quality.

The court is hearing a petition filed by five members of the Zoroastrian community against the construction of the underground Colaba-Bandra-SEEPZ corridor under two Atash Behrams.

The court had appointed the institute to examine the impact of the proposed Metro work (including tunnelling and construction of the proposed Kalbadevi station), both during its construction as well as operation of the Metro Rail — on structural safety of the Wadiaji and Anjuman Atash Behram; on the water levels (including any contamination) in the wells situated, within both the above Atash Behrams.
