No anticipatory bail for Tree House Promoter

The Mumbai Sessions Court, earlier this month, rejected the anticipatory bail application of Rajesh Bhatia, the MD and Promoter of Tree House Education and Accessories Limited. An investor had filed a case against him with the Economic Offences Wing (EOW) of Mumbai Police.

Bhatia had applied for anticipatory bail in the Session Court. On April 4, the court rejected his application. "Considering the nature of accusation made by the prosecution as pointed by me, the thorough investigation is necessary. Custodial interrogation is qualitatively more elicitation oriented than questioning a suspect who is well protected with a favourable order u/s 438 of CrPC," the court said.

The court added, "In a case like this, effective interrogation of a suspected person is of tremendous advantage in extracting much useful information. Success of such interrogation would elude if the suspect person knows that he is well protected by pre-arrest bail. His interrogation during the pre-arrest bail would reduce to a mere ritual".

EOW said in the court that it will verify the entries of all 210 accounts of Bhatia and will take help of a forensic auditor.

An investor had filed an FIR with EOW unit V in Mumbai on January 31, 2017. The investor has alleged that the promoters of the company are suspected to have inflated results, and in all probability, siphoned money from the company. The complainant alleged that capital expenditure of the company was also inflated in self operated schools.

In recent months, Tree House closed several of its centres and had to face the wrath of angry parents whose wards were affected. At several places, parents have lodged complaints with the police complaining about unexpected closure of centres.

DNA tried to reach out to the promoters of the company, but they could not be reached for comment. Rajesh Bhatia's phone was switched off and text message sent to his mobile number did not elicit any response. Calls placed to the company went unanswered.
