Mira Road woman who had cried rape gets court notice

The Esplanade court has issued a notice to a Mira Road resident, who had lodged a rape case against an associate of hers, asking her to file a reply to the city crime branch report. The B-summary report, filed with prosecution sanction in the case, states the woman had filed a false case.
The Supreme Court on May 28 had directed the Mumbai crime branch to investigate and submit its report.

Who is the woman?
The woman, along with one VV Jose, ran a business of sending nurses to the Gulf.

What was her complaint?
Her allegation was that Jose had raped her in connivance with the Kerala police in a Dongri lodge last year.

Why did she allege that?
Police investigation revealed she had concocted the story to frame Jose and the police as the former had lodged a cheating case against her at Chalakudy town in Thrissur district.

Why had Jose complained against the woman?
The police said Jose had collected lakhs of rupees from nurses seeking jobs, and had handed the money to the woman, who had said she would get Gulf visas for the nurses. However, she was unable to do so and also allegedly usurped the money.

What allegations and claims did the woman make?
She had said she was arrested on October 1 last year by the Kerala police and produced in a Thane court the next day. But instead of keeping her in lock-up, the police team, comprising sub-inspector PP Davis, assistant sub-inspector Girija Vallabhan and constable Sunita Hamsa, allegedly took her to New India lodge in Dongri.
On October 3, she was produced in a Kerala court where, she alleged, she was molested by the accused. She later changed her statement and alleged she was raped. In her complaint registered with the Dongri police in November, she also named Jose's friend Salim Ahmed as accused.
The woman later moved SC asking for a CBI investigation into the matter.

How did the crime branch probe proceed?
Officers examined 31 witnesses, and call records of the woman, Jose, Ahmed and the Kerala police. Polygraph tests of those named in the FIR, including the police officers, were conducted. Statements of people who were present in the other rooms of the lodge on the day the woman was allegedly raped were recorded.

What did the probe reveal?
Investigating officer and inspector Padmakar Devre said the woman had five cases of cheating registered against her, and was arrested in four of those cases by the Kerala police. In two of the cases, her husband is also an accused. "The time the victim claimed Jose had raped her, he was on a call with Ahmed," he added.
"We have sought prosecution of the woman under section 211 of the Indian Penal Code," said assistant commissioner of police Yashwant Vhatkar.
