ACB court tells prison authority to produce the duo on June 22

The sessions court on Wednesday granted bails to all the accused of the Maharashtra Sadan Scam case, except Chhagan Bhujbhal and Sameer Bhujbhal, who have been told to be produced before the court on June 22, as they are in judicial custody.

The other accused had come to court after summons were issued against them by the court after taking cognizance of the chargesheet filed by the anti-corruption bureau (ACB) in the Maharashtra Sadan scam.

The bail amount was fixed to Rs50,000, though special prosecutor wanted it to be Rs1 lakh. A production warrant would also be issued against the accused. Pankaj Bhujbhal, who was not present in court has also assured the court through his advocate to remain present in court on the next date.

Advocate Pradeep Gharat said on March 30, ED had filed an 11,500-page charge-sheet, naming Chhagan Bhujbal, Pankaj, Sameer and firms such as D B Realty, Balwa group, Neelkamal Realtors and Builders, Neelkamal Central Apartment LLP and Kakade Infrastructure in connection with the case. The charges relate to alleged irregularities in the construction of the state guest house 'Maharashtra Sadan' in Delhi and the Kalina land-grabbing case in Mumbai.

The prosecution case is that to construct Maharashtra Sadan, contractors Chamnkars associates had allegedly transferred money to Niche Infrastructure and other companies in which Pankaj and Sameer were directors. The chargesheet said that most of the companies floated by Bhujbals are in the name of employees and used for siphoning off funds. Niche was earlier owned by some employees of Maharashtra Educational Trust in which Bhujbals later became directors.

The ACB has further said that Rs45 crore was the original cost of Maharashtra Sadan and later it was shown to Rs50 crore. The officials also said that Rs13.5 crore is the total amount that Bhujbal got as kickback allegedly from Chamankars.

The ACB had said that Rs190 crore was the approximate profit that Chamankars got from Maharashtra Sadan and other works while the money were transferred to Niche by Chamankars after getting the project the money ultimately landed up to Sameer and Pankaj.

The prosecution has claimed that in the construction of Maharashtra Sadan, contractors have earned 80 per cent profits while as per the government circular such contractors are entitled to only 20 per cent gains. They added that the books of accounts were fudged to show that the profit earned was only one percent.
