The prosecution on Monday filed an application before the special court conducting the trial of actor Salman Khan in the alleged hit-and-run case, pleading the court to consider the evidence of two important witnesses currently not available to depose before the court.

According to the application, one evidence of the deceased police official Ravindra Patil, who was Khan's bodyguard while the mishap occurred, while other is the doctor, who had conducted post-mortem of the pavement dweller killed in the accident.

The prosecution said that Patil died of tuberculosis, while the doctor lives in the US and is not available to depose. However, he had given a statement to the magistrate earlier on the post-mortem. The statements of both these crucial witnesses were recorded by a magistrate during the trial.

Special public prosecutor Pradeep Gharat also filed Patil's death certificate. While this was admitted by Khan's lawyer Shrikant Shiwade, he disputed the fact that Patil died of TB. The court is expected to pass an order on the application on February 27.

The same day, the court is also likely to pass orders on the prosecution's plea asking the actor to produce his driving licence.

According to the prosecution, in September 2002, Khan ran his car over pavement dwellers sleeping outside a bakery in Bandra, killing one person and injuring four others.
