Govt to clarify stand on food in movie halls

The Bombay High Court asked the state government on Thursday to clarify its stand on the issue of moviegoers being prohibited from carrying eatables inside the movie hall and forced to purchase goods at exorbitant rates.

A division bench of Justice R M Borde and Justice Rajesh Ketkar were hearing a public interest litigation (PIL) filed by Jainendra Baxi. Advocate Aditya Pratap, appearing for the petitioner, argued that there was no legal or statutory provision prohibiting one from carrying personal food items or water inside movie theaters. The Maharashtra Cinemas (Regulation) Rules prohibits hawking and selling food inside theaters and auditoriums.

To which the court said when security guards frisk the patrons entering cinema halls and check their bags, what was the need to keep all their food items and force them to purchase food from theaters.

The court has given three weeks time to the government to file its reply to the petition.

Pratap said the prohibition on allowing outside food inside theaters particularly affected senior citizens and those who cannot eat, for medical reasons. It claimed that mostly the food available inside is junk like nachos, burgers etc which may not be good for the elderly. The petition reads that the only concern for theater owners, managing authorities and the state must be to ensure that no safety or security rule is breached by the public visiting such halls.
