An FIR was registered against former NCP MLA Rahul Mote and former board president Vinayak Patil of the Mahanand Dairy among others for causing alleged losses to the dairy. The FIR was registered after a complaint made by president of Maharashtra State Milk Distribution and Transport Association Shree Naik.

As per Naik's allegation, the Dairy gave a special advance of Rs65 lakh to Mote's Bhoom Cooperative in Osmanabad, way above the prescribed limit of Rs2.5 lakh. "It is a routine practice to give advance to small cooperatives to purchase milk, which is then adjusted with milk supplied over a period of time. However, in 2009, Mote sought Rs65 lakh and it was sanctioned," said Naik.

"While the money was given, no milk was given to Mahanand Dairy in return by the cooperative. In fact, the money was used for the Lok Sabha and assembly elections. When a 2009-10 audit report raised the issue, there was no action taken for the money given and no attempt made to recover it."

The FIR, besides mentioning Mote and Patil, names various people present in the board meeting in which the decision was made to give the money. "I have got all the details under the RTI. It was brought to the notice of cooperative minister Khadse who later put the issue to joint registrar of dairy. After an inquiry, an FIR was filed. It was passed on to the Economic Offences Wing," said Naik.

While Mote's phone was switched off, Patil said, "I am out of town and will reach tomorrow. I will be in a better position to comment after I come and see the papers. The decision was not taken by me alone but the entire board."

In the FIR, it was also alleged that additional municipal commissioner SVR Srinivas was the managing director of the dairy when the incident occurred. "I am shocked if my name is in the FIR. It is a very routine and administrative matter, giving advance money; it can always be recovered. What is criminal in that? Have they even sought sanction before including my name?" he asked.

DCP (EOW) Pravinkumar Padwal said, "We have taken an FIR and are investigating the matter."
