FIR against city builder over 'illegal' certificate

An FIR has been registered with the Anti Corruption Bureau (ACB) against one of Mumbai's top developers, two Brihanmumbai Municipal Corporation (BMC) officials, and others in connection with an Occupation Certificate. The Occupation Certificate (OC) to building number 6 in Raheja Green CHS, Borivli East, was issued after the developer allegedly submitted a false Drainage Completion Certificate to the civic body. However, the developer has refuted the allegation.

An FIR has been registered with the Anti Corruption Bureau (ACB) against one of Mumbai's top developers, two Brihanmumbai Municipal Corporation (BMC) officials, and others in connection with an Occupation Certificate. The Occupation Certificate (OC) to building number 6 in Raheja Green CHS, Borivli East, was issued after the developer allegedly submitted a false Drainage Completion Certificate to the civic body. However, the developer has refuted the allegation.

The FIR includes names of developer Sandeep Raheja, Palm Grove Beach Hotels Pvt Ltd, executive engineer of building proposal department (R ward) AB Kulkarni, assistant engineer PT Vichare, and others. The FIR was registered following an order by Special Judge (anti-corruption) Dilip Gudhade.

The allegation is that not only did the civic officials accept the DCC, but they also failed to conduct the mandatory inspection of the building required under Development Control Rules to verify and ascertain its compliance with the norms. The OC was granted to a building which did not have a drainage connection.

Advocate Aditya Pratap, who appeared in court for complainant Ashok Kotwalkar, secretary of Raheja Green CHS, said in an email to DNA: "The open space and fire safety of the residents of Raheja Green CHS have been compromised with by the developer. They are adversely affected by the illegal building number 6 developed by Sandeep Raheja's company, and have initiated civil and criminal proceedings against the developer."

The developer, on the other hand, has claimed that the allegations are baseless. In an email response, the company noted: "There is no truth in the allegation that building number 6 did not have a drainage line prior to the grant of the full Occupation Certificate for it; the society illegally and in an unauthorised way has blocked the drainage line of building number 6 and caused obstruction to the free flow of the building's sewage."

The email also stated that the said building was constructed by Prashasti Enterprise, and not by Palm Grove Beach Hotels Pvt. Ltd. and the DCC was received in February 2015, while the OC was received in April 2015.

The response concludes: "The complaint against inter alia Palm Grove Beach Hotels Pvt. Ltd. and its Directors by the Society and/or Mr Ashok Kotwalkar before the Special Judge under the Prevention of Corruption Act for Greater Mumbai is false and motivated with a view to blackmail Palm Grove Beach Hotels Pvt. Ltd. into succumbing to unreasonable demands of the said Society and Mr Ashok Kotwalkar."
