Bombay High Court: Reply to plea on Nagpada high-rise

A division bench of Justice Shantanu Kemkar and Justice Nitin Sambre issued the direction while hearing the plea filed by activist Mohammed Ahmed Umar Shaikh.

The Bombay High Court has asked the state government and Brihanmumbai Municipal Corporation (BMC) to file its reply on a Public Interest Litigation, filed alleging that a private developer has illegally constructed and sold flats on extra floors of a high rise, in Nagpada, in South Mumbai.

A division bench of Justice Shantanu Kemkar and Justice Nitin Sambre issued the direction while hearing the plea filed by activist Mohammed Ahmed Umar Shaikh.

It is alleged in the petition that Aafiyah realtors, were granted permission to construct ground plus 21 floors, but they have built extra floors. Moreover, the refuge and parking areas which are to be kept open and available to everyone, are being commercially exploited, thus posing danger to the occupants, during any untoward incident.

Advocate Mujahid Mulla appearing for Shaikh said "The Chief Fire Officer has not given NOC of occupation and even the Executive Engineer, has not issued occupancy certificate but the developer has allotted flats to the old tenements holder and new flat purchasers. Until, the clearances are obtained the developer has illegally allotted the flats, the authorities have not not taken any action."

The petition seeks due action from authorities against illegal constructions.
