Bombay High Court appoints receiver to oversee Rs 200 crore property

The Bombay High Court has appointed a court receiver, with a view to safeguard property worth around Rs 200 crore, on which the now defunct Palm Beach school stands at Napean Sea road.

The property belongs to Nikhil Jhaveri who suffers from Huntington's disease — a genetic disorder which affects motor functions. Jhaveri has filed a suit restraining any takeover, creating of any third party rights or any kind of dealing against his college friend Rusi Motiwalla. A few years ago, Jhaveri went missing from his sister's house in Kandivli and was later found loitering outside the Borivli police station. He was kept at an Ashram before being identified by the authorities who returned him to his family members. Later he was moved to Conwest and Manjula S Badani Jain hospital, where he is being treated.

Recently, he was produced in court by the hospital staff in an ambulance, and was interviewed in chamber by Justice SJ Kathawalla, who noted his condition to be pathetic. When the court tried to put some questions to him, the only answer that Jhaveri gave was that he was the Principal of Palm Beach School.

Medical Superintendent of the hospital informed the court that since 2014 till he was admitted, he is being looked after by Motiwalla and his brother-in-law Murlibhai Mehta. Further, Motiwalla has told the court that he is not interested in claiming any right on Jhaveri's property but is concerned of his welfare.

The parties to the suit agreed to the fact that the need of the hour is to house Nikhil at a place where he can be taken care of, and his property is protected.

Accordingly by way of interim relief the court appointed the receiver who would open the lock of the premise, video graph the entire property and seal it. The court has directed the receiver to file his compliance report on February 7. Jhaveri's son Ryan has been asked to clear the outstanding dues of the hospital.
