The Brihanmumbai Municipal Corporation (BMC), denying allegation by a former Indian Army Captian, said it has taken back the 13 gardens, which were leased to Prajapita Brahma Kumaris Ishwariya Vishwa Vidyalaya. It has also claimed to have locked and sealed the structures that were used by the organisation to practice spiritual activities and Yoga.

Advocate Dhruti Kapadia, appearing for the civic body, filed an affidavit in the court opposing a petition filed by former Indian Army Captain, Haresh Gaglani, who had alleged that the organisation was illegally occupying and preventing the general public from entering the gardens.

The affidavit read, "Petitioner's allegations are not true and with records herein, it is clear that the relief sought in the plea does not survive, as possession of the gardens are already handed over to the corporation. Under these circumstances, the petition should be dismissed."

Gaglani, in his plea, had claimed that the corporation had given the gardens on lease to World Renewal Spiritual Trust, which closely works with the Prajapita Brahma Kumaris, He alleged that despite the lease being expired, the trust still illegally possesses the gardens.

The plea says the gardens, which are spread out across different municipal wards, are prime parcels of land and thus causing heavy loss to the state exchequer. It also added that the trust has built permanent structures inside the gardens, which are being used for various illegal purposes, like holding fundraising functions etc.
