Bank duped of Rs 6 cr, docs booked

Central Bureau of Investigation (CBI) has registered a case of cheating and forgery against a doctor couple for allegedly duping State Bank of India (SBI) to the tune of Rs 6 crore.

Those against whom a First Information Report (FIR) has been registered are M/s Asha Nursing Home, Kalamboli, New Panvel, Dr Vijay Dongre, his wife Dr Asha Dongre, two advocates and unknown public servants. 

M/s Asha Nursing Home is a partnership firm having its office at Kalamboli, engaged in business of operating Super Specialty Hospital.

According to the CBI, during the period of 2014 to 2017, credit facilities were sanctioned to a Kalamboli-based nursing home of the couple and its partners by erstwhile State Bank of Patiala (now SBI), Bhandup Branch.

“The borrowers had approached the bank for sanction of credit facility for construction of hospital building on the leasehold plot of CIDCO. The partners of the firm had offered leasehold plot of CIDCO as primary security and other immovable properties as collateral securities. Title Investigation Reports (TIR) of the said property was carried out by two advocates and they in their TIR had claimed that the title deeds are genuine,” said a CBI official.

He added, meanwhile, the borrowers had constructed the hospital building and had started operating the hospital from this new premise. “Due to non-servicing of interest and instalment in term loan account beyond 90 days, the account was classified as NPA in January 2017,” the official said.

As per the agency, the fraud came to light and to the knowledge of the bank when they received summons from Economic Offences Wing of Navi Mumbai Police.

LEGAL OPINION

The bank obtained legal opinion from M/s NKS Legal to ascertain the genuineness of documents related to primary security. NKS Legal had opined that the borrower is not having clear and marketable title over the this and their title to the property was found to be fake
