Waste water and pay Rs 10K penalty, proposes draft bill

Water supply and sewerage system of Jaipur will soon be under an autonomous board. A draft of the bill for constitution of the Jaipur Supply and Sewerage Board (JSSB) bill has been prepared by Rajasthan Urban Infrastructure Development Project (RUIDP). The draft proposes cash and imprisonment penalties for those guilty of waste or misuse of water.

Water supply and sewerage system of Jaipur will soon be under an autonomous board. A draft of the bill for constitution of the Jaipur Supply and Sewerage Board (JSSB) bill has been prepared by Rajasthan Urban Infrastructure Development Project (RUIDP). The draft proposes cash and imprisonment penalties for those guilty of waste or misuse of water.

“In case of a first offence, fine may extend to the specified amount  (Rs 10,000 for misuse of water) or simple imprisonment which may extend to a period of one month or both” proposes the draft bill.

Those who continue ‘wasting water’ despite first conviction, will thereafter, be liable for a penalty of Rs 1,000 for each day.  

Similar penalties have also been proposed for violations such as tampering of water supply and sewerage lines.

In case where violation of the act occurs at a property with different occupier and owner, both will be jointly liable. In issues where damage has been caused to the board’s property those responsible will also have to bear the repair cost.

The proposed board will hold jurisdiction on management of all water and sewerage facilities at Jaipur urban area. The related assets and staff deployed at management of these with local bodies like JDA, JMC, RIICO and others will be duly transferred to the board according to proposed process.

Water charges may rise: Along with improving quality of water supply, a core objective of the board will be to make the system self-reliable. Presently, the government is able to recover only 30 per cent of the operation and maintenance cost of water supply system. Even as the government will initially assist the board to fill the viability gap over the years it will have to become self reliant and thus may levy more charges on users.

Waste connections must: No new construction or reconstruction of building will be allowed at any property in distance of 35 meter from sewer under the JSSB without due drain or sewer facility developed to satisfaction of the board. Such a drain to carry waste and filth from the building must be duly connected to a board sewer. However, no power has been defined for the board to prohibit a construction in violation of the norm.

The proposed JSSB bill is under policy reforms agreed by the state government for implementation of sewerage and water supply improvement projects with loan assistance of Asian Development Bank. Similar boards will are also recommended at several other cities under the project, ADB is expected to provide loan of 500 million USD (Rs 32.7 crore) for the works.
