J&K government ‘special status’ hits fake arms licence probe

The investigation in fake arms licence case by the Anti Terrorism Squad (ATS) of Rajastha Police has hit roadblock as suspected beneficiaries from the J&K government are allegedly trying to save their skin by quoting legal aspects. Claiming that cases under Indian Penal Code (IPC) cannot be made binding in J&K, the authorities have managed so far to keep ATS sleuths at bay. However, the state police is now trying to seek legal solution to the battle.

The fake arms licence case has three major players viz the gang and conspirators, the beneficiaries and the accomplices and links of the gang in the J&K government. “We have busted and arrested the first player in the matter while action against the beneficiaries is ongoing as so far we have arrested 50 men while more arrests would be made. We are now focussed on the third player in the matter and we suspect they won’t yield so easily, but we are not giving up as well,” sources said.

Sources reveal that the authorities are reluctant to help identify and weed out those officials who had played role in the issuing of the fake licences. “Though we have faced difficulty, however, that doesn’t mean that we haven’t investigated the third category. There is enough information with us that points at certain officials, however, just on the basis of that information we cannot act as we need to develop it further,” officials said.

Interestingly, ATS sleuths confess that they are facing a couple of issues due to which no arrests have been made. “It is because of a couple of factors the third category hasn’t been arrested. Firstly, when we approached them the authorities claimed that the data of licences issued, for the time which we sought, was unavailable with them. when we questioned as to how such a sensitive data can be missing, they did not show further interest. Secondly, when we persisted with the questions, we were told that the reports have been washed away in floods,” sources told DNA.

Interestingly, what appears to be their suit is the legal aspect. “They quote that we r investigating under IPC so they don’t fall under our jurisdiction. That is a big issue that needs to be tackled,” sources said, further adding, “However, several high-level meetings have been undertaken to find a way in the legal battle process. We just need a little push and we will break the chain there as well. We have solid evidences however the legal issue needs to be clarified.”

CBI APPROACHED

Rajasthan police even approached CBI. “We have approached the CBI because the agency has pan-India approach and all the major development in the matter has occurred out of the state,” sources said.
