"Yes yes... there is a limitation as law and order is a state subject. We need to evolve ourselves to meet these kind of challenges. We need to evolve such systems and also the laws to meet such challenges," he told PTI here on the sidelines of a seminar here on 'Human rights of victim of terror attacks'.
The minister was asked if there was a need to evolve laws which would help the Centre to directly take over the charge of probing terror attacks such as the recent one in Varanasi, Uttar Pradesh.
Moily said he had dealt with the issue in his two reports on combating terrorism and conflict resolution as part of the second Administrative Reforms Committee report.
Addressing the seminar, he cited the American example for explaining the problems faced by the Centre in dealing with terrorist attacks in states.
Moily said the US President could take direct action anywhere in his country but in India, the president will first have to request the state chief minister and then a long process would be followed.
"In our federal law, there is some problem...Sometimes when it comes to terrorism, we have to conquer this kind of disability and limitations that we have. We have still not evolved that kind of a system to take over this kind of responsibility at the national level to meet the challenges of terrorism," he said.
Commenting on the role of human rights organisation, the minister said, "Generally, our activists and NGOs think they should be the champions of rights of people who attack us and not the victims. I think our attention should go first to victims."
The law minister said world-over a culture should be developed among the citizens where they treat all terror attacks as an attack on humanity.
He said terrorists were earlier known to be coming from outside only but due to the creation of "militant behaviour" by some groups, terrorist mindsets were being created within the society also.
