The Supreme Court has directed action against an additional district judge, Archana Sinha, posted in Delhi, for defying its order, after rejecting her repeated pleas for ‘mercy’.
Sinha was present in the court.
The apex court had directed the eviction of a tenant charitable organisation but Sinha stayed the eviction proceedings. She overwrote the SC’s order. “Our heads hang in shame”, a bench of justices Markandey Katju and Gyan Sudha Misra said, while slamming the ADJ.
Sinha had tendered an unconditional apology in the open court but the judges felt it was time to send a “stern message” across the country against “growing corruption in the subordinate judiciary”.
“Archana Sinha had no business to defy our order and she has become a super Supreme Court,” an anguished court said, disregarding lawyer Jayant Bhushan’s plea seeking mercy for Sinha. Earlier on November 2010, justice Katju and Misra had blasted the Allahabad High Court, with the former saying, “Something is rotten in the State of Denmark, said Shakespeare in Hamlet, and it can similarly be said something is rotten in the Allahabad High Court, as this case illustrates.”
