It’s lawyers vs judges at the Allahabad high court

In a surprising development, the Allahabad High Court Bar Association has adopted a posture diametrically opposite to that of the judges vis-à-vis the adverse remarks made by the Supreme Court regarding corruption and nepotism in the Allahabad high court.

The judges had decided on Friday to file a curative petition in the Supreme Court for expunging the severe remarks.

But, in a resolution passed at a meeting held in Allahabad on Friday, the bar association called for action to cleanse the high court as indicated by the apex court in an order delivered by Justices Markandey Katju and GS Mishra on November 26.

The apex court had said that “there is something rotten” in the Allahabad high court and had asked the high court chief justice to take corrective action, including transfer of “the incorrigibles”.

“The Supreme Court verdict should be honoured since it is binding on all of us. The points should be addressed urgently,” said a resolution passed by the bar association governing council.

“We will also request the high court chief justice to take action against the judges as indicated in the Supreme Court judgment,” NC Rajvanshi, the bar association president told reporters.

Many in judiciary circles are surprised. Initially, sources had indicated that the bar (the lawyers) would largely support the bench (the judges) in their demand that the damaging remarks be withdrawn from the apex court order.

The resolution adopted has changed the scenario entirely. Observers say this could affect relations between the bench and the bar in one of the oldest and most reputed courts of the country.
