Ishrat’s mother challenges Tamang report stay in SC

The Union government may takes it’s own time in deciding when to move the Supreme Court (SC) in the Ishrat Jahan fake encounter case, but the slain student’s mother Shamima Kausar has sought from the top court a direction to prosecute the killer cops.
Kausar moved the SC on Thursday challenging the Gujarat high court (HC)’s order staying a judicial probe report which had termed the encounter a “cold-blooded murder”.

The petition, filed by advocate Kamini Jaiswal, contended that the HC had wrongly entertained the petition of the Gujarat government and granted stay on the report of judicial magistrate SP Tamang.

Tamang’s report said the police masterminded and executed the killing of Ishrat and her three friends — Javed Ghulam Sheikh alias Pranesh Kumar Pillai, Amjad Ali alias Rajkumar Akbar Ali Rana and Jisan Johar Abdul Gani — in a fake encounter.

Tamang had allowed publication of the report and also recommended action against the cops. However, the HC stayed the report on September 9 following a plea by the Narendra Modi government, which contended that the observations made were beyond the jurisdiction of a magistrate.

The state defended the murders by saying the four persons were planning to assassinate Gujarat chief minister Narendra Modi. The government waved a Central affidavit backing its claim that Ishrat Jahan and her associates were linked to the  Lashkar-e-Taiba.

The affidavit evoked heated reactions from the Centre. During his recent visit to the United States, home minister P Chidambaram said, “If a state government acts as though intelligence inputs are evidence or conclusive proof, I’m sorry for that government’’.
