Human rights panel slams education department

Helps 2 staffers whose rights were violated.

State education department, which has often been criticised for goof-ups, has now been slammed by State Human Right Commission (SHRC) for violating human rights of its two employees.

Reports said the department stopped salary of Jitendra Prabhatbhai Vasava, a scheduled tribe employee, and held it back for more than a year. Vasava served in a college for 10 years but for the last five years the college administration had been harassing him.

Even though he was qualified enough, Vasava was allegedly sidelined by the college authorities and his salary was stopped. Vasava even took the matter to State Education Tribunal and the tribunal gave an order in Vasava's favour, but the state education department and college authorities still did not respond.

A dejected Vasava then lodged a complaint with SHRC. While submitting the details of his plight, he mentioned that he along with family would commit suicide if the justice still eluded him.

The Commission then sought a report from the director of education (college) and superintendent of police. The latter submitted his report, but the director ignored the commission's order. Following this, the commission conducted the hearing in Vasava's plea at regular intervals and also heard the version of State Higher Education Commissioner's office.

Having gone through all the evidences, the commission concluded that Vasava's human rights had been violated by the college administration and State Higher Education Commissioner's office. The commission ordered the state education department to take back Vasava in service and also pay the salary for the period of his discontinued service.
In another case, MB Vidja, a senior clerk of State Higher Education Commissioner's office, also got justice after the SHRC's intervention. Vidja was issued a transfer order by State Mid-day Meal Commissioner from Gandhinagar to Surendranagar district even though he was employee of a Higher Education Commissioner's office.

Vidja contended that his transfer was without any reason and also invalid because the mid-day meal commissioner do not enjoy the powers to transfer employees working under other authorities. Interestingly, higher education commissionr's office also released Vidja.

Finally, Vidja filed a complaint with SHRC, which sent notices to both the commissioners as well as the state education department. After an investigation, higher education commissioner and state education department found that Vidja's transfer had no validity. This led to revocation of Vidja's transfer order.

Sources said the state education department has initiated high-level inquiry to identify the people who committed negligence in both the cases.
