Gujarat high court asks builder to get building use permission

In a case involving residents of Dhananjay Towers and its builder Agrawal Estate, the Gujarat high court has asked the builder to get the Building Use (BU) Permission within six months.

The residents of Dhananjay Towers had approached the State Consumer Redressal Commission against the builder for not providing BU permission to the residents.

The commission after hearing the case ordered the builder to provide the permission within six months. The builder however filed an application for review of the order before the commission.

The residents of the tower then approached the high court against the application filed by the builder.

The division bench of Chief Justice SJ Mukhopadhaya and Justice KM Thakar after hearing the arguments ordered that the commission cannot review its own order and directed the builder to comply with the order of the commission and provide the BU permission to the residents.

The dispute between the residents and the builder arose after the construction of the building was completed in 1999. The builder had failed to obtain BU permission. After failure of talks between the two, the association of the residents approached the Consumer Commission seeking direction to obtain BU permission.

The commission in November 2006 ordered the builder to obtain BU permission within six months.
