Delhi Master Plan challenged in Supreme Court

NEW DELHI: A citizens' forum on Friday challenged the Delhi Master Plan-2021 in the Supreme Court, contending that instead of making the national capital a world-class city before the 2010 Commonwealth Games, it will end up ruining the quality of life of residents.

In an application moved through counsel Jasbir Malik, the Delhi Pradesh Citizens' Council also termed the master plan as 'ultra vires and violative of fundamental rights of citizens' and urged the apex court to quash it.

"The Master Plan cannot make Delhi a world-class city ahead of the Commonwealth Games 2010. It will instead end up ruining the quality of life of residents," said the petitioners.

Questioning the notification, the petitioner alleged that the government rushed through the master plan to appease the voters and negate the court's directions to seal the commercial establishments operating out of residential premises in various parts of the national capital.

The petitioner contended that the new master plan also ignores various provisions of the Delhi Municipal Corporation Act, 1957, New Delhi Municipal Council Act, 1985, the Delhi Development Act, besides many other relevant laws.

The forum contended that extensive modifications in the master plan adversely affects the land usage norms, standards of population of density and floor area ratio in the national capital without providing adequate infrastructure for various essential civic amenities like power and water.

The net fall out of the master plan, permitting the commercial use of the residential areas would lead to further destruction of the quality of life in the capital, the petitioner said adding that even the valid objections raised by bonafide residents had not been considered by the committee examining the plan.

The forum said that except for regularising all kinds of illegal and unconstitutional activities undertaken by violators and encroachers at the cost of law-abiding citizens, the master plan does noting to ameliorate the standards and quality of life of Delhi residents.
